At Sunshine Studio Moose Creek, we care deeply about your safety, well-being, and overall experience. These Terms & Conditions outline important information about participating in our services and help ensure a safe and respectful environment for everyone. Please read carefully and reach out with any questions.

1. Liability, Risk, Health & Consent

1.1 Assumption of Risk and Waiver of Liability
I understand that participation in physical activity involves inherent risks, such as but not limited to:

• Minor injuries (e.g., muscle soreness, bruises)

• More serious injuries (e.g., joint/back injuries, broken bones, concussions, heart-related events)

• Rare but severe outcomes (e.g., paralysis, death)

This list is not exhaustive, and I voluntarily assume all risks.

Sunshine Studio Moose Creek and its officers, directors, owners, instructors, contractors, employees, representatives, and agents (collectively, the “Studio Parties”) will not be liable to you or any other person for damages or losses arising from your participation in any activity offered by or through them, including but not limited to classes, workshops, personal training, space rentals, or other services, whether in person or virtually. I understand that it is my responsibility to participate within my own limits, and I accept full responsibility for any injuries or health issues that may arise.

I further agree that I waive any claims arising from the negligence of the Studio Parties and I agree that in no event shall the Studio Parties be liable for any indirect or consequential damages.

1.2 Health Representation & Personal Health Responsibility
I confirm that I am medically fit to participate in the Services and agree to disclose any relevant conditions prior to participating. I understand that instructors may limit or deny my participation for safety reasons.

I agree to monitor my condition and communicate with instructors if I feel unwell. While instructors will do their best to offer accommodations and alternatives, I am responsible for knowing my limits, monitoring my condition, and deciding whether to participate. I understand that I should consult my healthcare provider if I have any concerns about my ability to participate safely.

1.3 Emergency Medical Authorization
If there’s ever a situation where I require emergency care and can’t speak for myself, I authorize the Sunshine Studio Moose Creek team to seek help on my behalf. I release the Studio Parties from liability for any decisions made in good faith during such emergencies.

1.4 Outdoor Classes Disclaimer
I understand that outdoor classes can be a fun way to move, but they do come with their own set of challenges beyond the studio’s control — like insects, uneven terrain, or sun exposure. I take full responsibility for my participation in outdoor classes and understand that the studio can’t be held liable for things like bites, allergic reactions, or injuries related to the environment.

1.5 Minors and Parental Consent

Participants under 18 years of age must have this agreement signed by a parent or legal guardian before taking part in any studio services. By signing, the parent or guardian confirms they are legally authorized to do so and that they:

• Agree to all terms outlined in this document on the minor’s behalf

• Accept the risks involved with the minor’s participation (see Section 1.1)

• Will share any important health information about the minor before participation

• Give permission for emergency care if needed (see Section 1.3)

• Release and hold harmless the Studio Parties from any claims related to the minor’s participation

1.5.1 Participation and Responsibility

Parents or guardians are welcome to observe, or depending on the class, join in—with prior approval. If they choose to observe or participate, they do so at their own risk, and the studio is not responsible for any injuries or incidents that may occur.

If someone else (e.g., an aunt, older sibling) is bringing the minor to class or participating with them, they must complete a separate authorization and consent form in advance.

1.5.2 Supervision Before and After Class

Parents and guardians are responsible for ensuring minors are dropped off and picked up on time. The studio team is unable to supervise minors outside of scheduled class times.

1.5.3 Babies in Class and Baby-Friendly Participation

Sunshine Studio Moose Creek welcomes parents and caregivers to bring their little ones to designated baby-friendly classes. That said, the studio does not provide childcare or supervision.

Parents and caregivers are fully responsible for their child’s safety, comfort, and supervision at all times. Babies must remain in a designated area or with the parent/caregiver and always within their line of sight.

By choosing to bring a baby to class, participants acknowledge and accept the inherent risks, and agree that the Studio Parties will not be held liable for any accidents, injuries, or incidents involving children while on the premises.

1.6 Severability
If any part of this agreement becomes unenforceable or invalid, the rest still applies and remains in full effect.

1.7 Athlete Training Restrictions
Sunshine Studio Moose Creek focuses on wellness and recreation. We do not offer training designed for professional, semi-professional, or high-performance (carded) athletes.

1.8 Prohibited Substances
To keep the studio a safe and inclusive environment, alcohol is not permitted during studio activities or on the premises.

1.9 Governing Law
This agreement is governed by the laws of Ontario and applicable federal laws of Canada.

1.10 Signature Validity
This document may be signed electronically or in person. Both methods are valid, and multiple signed copies together make up one agreement.

1.11 Photography & Media Release
The studio would love to capture joyful moments in class and possibly use photos or videos for promotional purposes.

If you prefer not to be photographed or recorded, please let the studio know by email at sunshinestudio.moosecreek@outlook.com before attending.

This also applies to parents/guardians on behalf of minors (see Section 1.5).

1.12 Email Consent
By sharing my email, I agree to receive occasional studio updates and announcements.

You can unsubscribe at any time.

2. Payment Terms

Payments can be made easily through the studio’s online booking system. All services must be paid for in advance to reserve your spot.

3. Policies

3.1 No-Show Policy
Things come up, it’s understandable! That said, missing class without notice takes away a spot someone else might have wanted.

Because all classes are prepaid, no-shows aren’t eligible for refunds or credits.

Repeated no-shows may lead to limited booking access, just to ensure fairness for everyone.

3.2 Cancellation Policy
Sunshine Studio Moose Creek kindly asks that cancellations be made at least 5 hours before class start time to allow others a chance to join. Cancellations made after that are considered “late” and are not eligible for refunds or credits. Though the studio understands that life happens, so exceptions can be made in specific cases.

Valid exceptions include:

• Illness: If you’re experiencing sudden symptoms (fever, chills, nausea, etc.) or become unwell before class.

• Unexpected Injury: A new or sudden injury that prevents safe participation.

• Severe Weather: Your safety is top priority - please cancel as early as possible if it feels unsafe to travel.

• Emergencies: Medical or safety-related situations (e.g., ambulance, fire, police).

To request an exception, please email sunshinestudio.moosecreek@outlook.com the same day. All requests must be sent by email.

Sunshine Studio Moose Creek works on an honor system. If frequent exceptions are requested, the studio may reach out for a friendly check-in to revisit expectations.

3.3 No Refund Policy & Non-Transferability
The studio aims to be as flexible and understanding as possible. While all purchases are non-refundable, we understand that life happens. Sunshine Studio Moose Creek may offer a credit in special situations - this is at the studio’s discretion.

All purchases are non-transferable and can only be used by the person who registered or made the purchase. Thank you for your understanding and support.

4. Contagious Illness Policy

To keep our studio community healthy and safe, I agree to stay home if:

• I’m showing any signs of illness (fever, coughing, vomiting, etc.)

• I’m waiting on test results

• Someone in my household is ill and may put others at risk

If I test positive for a contagious illness after attending a class, I’ll notify the studio so appropriate contact tracing precautions can be taken. I’ll do my part to keep everyone safe by resting and recovering at home. Thank you for helping keep the studio safe and cozy for all.

5. Code of Conduct

Sunshine Studio Moose Creek is working to build a community that feels warm, inclusive, and safe for everyone. By signing, I agree to:

• Respect others – Be kind, inclusive, and supportive

• Be on time – Arriving on time helps the whole class flow

• Follow studio guidelines – Including instructions and safety protocols

• Communicate respectfully – Share feedback or concerns constructively

• Protect privacy – Respect others’ personal information and stories

• Own my impact – Understand that serious or repeated issues may result in a discussion and, if needed, a temporary or permanent suspension of participation

6. Studio Use & Property Respect

To keep the studio welcoming and tidy for all, I agree to:

• Wear clean indoor shoes (no outdoor footwear on the studio floor)

• Treat all equipment and space with care

• Avoid bringing food or drinks into the studio (other than water)

• Tidy up after myself and return borrowed items

• Let staff know if something breaks or doesn’t feel safe

• Store personal belongings in designated, unlocked areas, at my own risk

If guidelines are repeatedly ignored or studio property is intentionally damaged, participation may be paused or ended.

7. Acknowledgment and Agreement

By signing this agreement (upon creating an account with Sunshine Studio Moose Creek), I confirm that I’ve read and understood everything outlined above - and I agree to the terms with a full heart and clear mind.
